What Happens During Probate?

When a person passes away, all of the assets that are in their name must pass through a court-supervised process called probate. Probate courts determine how a decedent’s assets will be distributed to their heirs and other beneficiaries of the estate. In general, the probate process takes at least nine months. Probate courts also charge fees worth around 3% of the value of the estate to the executor and 3% to the attorney representing the executor.

During the probate process, the following occurs:

  • The court determines if there is a valid will
  • The court will complete an inventory of all the property and assets in the estate
  • The court will appraise the value of the property and assets
  • The court will distribute your property in accordance with the will or the orders of the probate judge
