The Probate Process Explained

Following the death of a loved one, all the assets that were in their name will have to go through the probate court to determine how they should be distributed to heirs and other beneficiaries of the estate. Probate generally takes at least nine months to complete and the court also charges fees worth around 3% of the value of the estate to the executor and 3% to the attorney representing the executor.

Courts will perform the following tasks when an estate is probated:

  • Determine if there is a valid will
  • Complete an inventory of all the property and assets in the estate
  • Appraise the value of the property and assets
  • Distribute your property in accordance with the will or the orders of the probate judge
